1. Seller
The "Toutes mes histoires" service (toutesmeshistoires.com) is published and operated by FLOWBLOG, a French single-member limited liability company (EURL) registered under number SIREN 993 014 307 (the "Seller"). Payment processing is carried out on its behalf by Devhighway LLC (United States) via Stripe. Contact: contact@toutesmeshistoires.com.
2. Purpose & products
These Terms and Conditions of Sale ("Terms") govern the sale of the following products, created from a child’s photo and first name:
- ✦Digital plans (Mini, Story, Magic, Family): illustrated book in digital format (PDF / flipbook), including, depending on the plan, the story narrated in audio, the parent’s cloned voice and additional characters.
- ✦Printed book: a personalized hardcover book, printed and delivered to your home.
- ✦Personalized puzzle: a puzzle featuring the cover of the child’s story.
As the products are generated from the elements provided by the customer (photo, first name, style choices), they are personalized goods and content, made to their specifications.
3. Prices
Prices are shown in euros inclusive of all taxes. The applicable rates are those displayed on the Pricing page at the time the order is confirmed. For the printed book and the puzzle, any shipping costs are shown before the order is confirmed. The Seller reserves the right to change its prices at any time, with pending orders remaining governed by the price accepted when they were confirmed.
4. Order & payment
The order is confirmed after acceptance of these Terms and full payment. Payment is made online securely via Stripe; the Seller has no access to your bank details. The order is confirmed by a summary email.
5. Delivery
- ✦Digital products: available immediately in your library after generation and payment, and downloadable without delay.
- ✦Printed book & puzzle: produced and shipped by our printing partner Prodigi. Estimated times within the European Union are generally a few business days of production, plus the carrier’s shipping time. Times may vary depending on the destination and periods of high demand.
6. Right of withdrawal — exception (personalized product)
In accordance with article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital goods and content that are clearly personalized, nor to digital content whose execution has begun with your consent before the end of the withdrawal period.
As our products are custom-made from your child’s photo and choices, they are excluded from the right of withdrawal. By launching the generation of the complete book (digital plan) or by confirming an order for a personalized printed product, you expressly acknowledge and accept this exclusion and waive your right of withdrawal.
A free preview is offered before any purchase so that you can judge the result before unlocking the full creation.
7. Warranties & claims
The customer benefits from the legal warranties of conformity and against hidden defects provided for by applicable law. In the event of a printed product that is defective, damaged or not in conformity with the order, contact us at contact@toutesmeshistoires.com; we will proceed with replacement or correction as quickly as possible. As the content is generated by artificial intelligence, slight stylistic imperfections do not constitute a defect of conformity.
8. Consumer mediation
In accordance with articles L612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the consumer may use a consumer mediator free of charge. The contact details of the competent mediator are provided on request at contact@toutesmeshistoires.com. You may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.
9. Ownership & use of creations
The creations generated are intended for personal and family use. Any resale or commercial exploitation of the content is prohibited without the Seller’s prior written agreement. The processing of the child’s photo and voice is detailed in our Privacy Policy.
10. Governing law & disputes
These Terms are governed by French law. Failing an amicable resolution or resolution through mediation, any dispute will be brought before the competent courts in accordance with the applicable rules, without prejudice to consumer protection provisions.
